Terms of Service

These terms set out how we confirm bookings, what each party needs to do, and how we help keep Events safe.

Effective date

September 12, 2026

Keep a copy of these terms with your booking records.

Before submitting a booking request, please read these Terms carefully. By confirming a booking with Once Upon a Fun, you agree to these Terms and the written documents that apply to your Event.

01

Introduction and Acceptance

These Terms of Service, together with any written quote, booking confirmation, signed event agreement, invoice, approved add-on, and applicable written media release, govern services provided by Once Upon a Fun Entertainers and Event Planning Inc., doing business as Once Upon a Fun (the “Company,” “we,” “us,” or “our”).

In these Terms, “Client,” “you,” and “your” mean the person or organization requesting or booking services. “Services” means event planning, children’s entertainment, character appearances, mascot entertainment, face painting, decorations, and related services that we agree to provide. “Event” means the date, venue, time, and services described in the applicable written booking materials.

Submitting a website form or asking for information is an enquiry only. It does not reserve a date, create a confirmed booking, or guarantee availability. A booking is confirmed only after we have issued or accepted a written quote or booking confirmation, received the required 50% non-refundable deposit, received a signed event agreement, and sent written confirmation that the booking is confirmed.

If these Terms conflict with a signed event agreement for a particular Event, the signed event agreement controls for that Event to the extent of the conflict.

02

Services, Availability, and Substitutions

We provide event planning, children’s entertainment, character appearances, mascot entertainment, and related services as described in the written quote, booking confirmation, or signed event agreement. All Services are subject to availability, written confirmation, venue conditions, and timely payment.

We will use reasonable efforts to provide the entertainers, mascots, characters, activities, and services confirmed for your Event. If an entertainer, mascot, character, or provider becomes unavailable because of illness, emergency, safety concerns, transportation disruption, or another unforeseen circumstance, we may offer a reasonably comparable substitute when possible. We will make reasonable efforts to notify you as soon as practical.

A particular entertainer, mascot, or character is not guaranteed unless it is expressly confirmed in writing. If we cannot provide a reasonably comparable substitute, the Company cancellation provisions in Section 8 apply.

03

Booking, Payment, and Late Payment

A 50% deposit of the total confirmed booking fee is required to secure an Event date. The deposit is non-refundable in the event of a Client cancellation, subject to any rights that cannot legally be excluded.

The remaining balance is due 10 business days before the Event, unless we agree otherwise in writing. Payment methods, taxes, approved add-ons, travel fees, parking charges, and other Event-specific charges will be shown in the applicable quote, invoice, booking confirmation, or signed event agreement.

If the balance is not received by the due date, we may contact you to discuss the account on a case-by-case basis. We may release the date, decline to provide Services, or take another reasonable step only after giving written notice. A delay or forbearance in enforcing a payment deadline does not waive our right to require payment for the Event.

04

Client Responsibilities and Venue Conditions

The Client must provide a safe, suitable, and respectful Event environment for performers, guests, and staff. This includes adequate performance space, safe access and exit routes, reasonable parking or loading access where needed, climate control or weather protection appropriate to the Event, and any venue permissions required for the Services.

A responsible adult must supervise children and guests throughout the Event. Our staff are entertainers and event-service providers. They are not responsible for supervising children or providing childcare.

The Client must ensure that no harmful, illegal, unsafe, or inappropriate activities occur at the Event. The Client must not ask performers to engage in conduct that is unsafe, offensive, illegal, sexually inappropriate, discriminatory, or inconsistent with the performer’s role, training, or character requirements.

05

Outdoor Events and Weather

Outdoor Services require clear and safe weather conditions. We do not perform outdoor Services in rain, snow, storms, lightning conditions, or other weather conditions that are unsafe or unsuitable for performers, equipment, costumes, or guests.

The Client is responsible for arranging a safe indoor backup location for an outdoor Event when weather may affect the Services. We may delay, modify, relocate, decline, or stop Services if actual or anticipated weather conditions are unsafe or unsuitable. Where possible, we will discuss reasonable alternatives with the Client.

Any Client request to move an Event because of weather is handled under the case-by-case rescheduling process in Section 7. If no safe alternative is available, the cancellation and force majeure provisions in these Terms and the signed event agreement, if any, will apply.

06

Health, Safety, and Performer Conduct

We may refuse to begin, pause, modify, or end Services if conditions are unsafe or if a performer is subjected to harassment, violence, threats, unsafe requests, illegal activity, or inappropriate conduct. Examples include an unsafe venue, inadequate supervision, unsafe weather, intoxicated or aggressive guests, blocked exits, or unsafe equipment.

Where practical, we may give the Client an opportunity to correct a safety concern. We are not required to continue Services if the concern cannot be corrected promptly or if doing so may place anyone at risk.

If we end Services because of unsafe, abusive, illegal, or inappropriate conditions caused by the Client, guests, venue, or third parties at the Event, no refund is required for Services that cannot be completed. The Client remains responsible for amounts due under the confirmed booking, subject to applicable law.

07

Client Cancellations and Rescheduling

All cancellation requests must be submitted in writing to info@onceuponafun.com. A request is received when we acknowledge it in writing or when it is delivered to that address without a delivery error, whichever occurs first.

08

Company Cancellation and Force Majeure

If we must cancel or cannot complete Services because of illness, emergency, safety concerns, force majeure, or another circumstance beyond our reasonable control, we will use reasonable efforts to provide remedies in the following order:

  1. Comparable substitute: We will first try to provide a reasonably comparable entertainer, character, provider, or service.
  2. Rescheduled Event: If a comparable substitute is not reasonably available or cannot be accepted, we will offer a rescheduled date at no additional charge for the same confirmed Services, subject to availability.
  3. Refund: If a comparable substitute and a rescheduled date are not reasonably available, we will refund amounts paid for the affected Services, including the deposit, as the final remedy.

“Force majeure” means an event beyond our reasonable control, including severe weather, road closures, power outages, government restrictions, public-health emergencies, labour disruptions, venue closure, accident, transportation interruption, or natural disaster. To the maximum extent permitted by applicable law, the remedies in this section are the Client’s remedies for a Company cancellation caused by force majeure or circumstances beyond our reasonable control. Nothing in these Terms limits a right or remedy that cannot legally be excluded or limited.

09

Photography, Video, and Promotional Media

Photos or video may be taken during an Event for operational, safety, or record-keeping purposes. The Company may use Event photos or video in social media, advertising, promotional materials, our website, and our portfolio only with the Client’s prior written consent.

Promotional-media consent is separate from the booking itself. The Client may decline promotional use without affecting the availability of Services. If the Client provides consent, the Client confirms that they have authority to grant that consent and, where required, have obtained permission from parents, guardians, guests, or other individuals who may appear in the media.

The Client may withdraw consent for future promotional use by contacting info@onceuponafun.com. Withdrawal does not require us to remove material already printed, distributed, scheduled, or otherwise irreversibly published before we receive and can reasonably process the request.

10

Privacy and Booking Information

We collect personal and Event information that is reasonably necessary to respond to enquiries, prepare quotes, confirm and provide Services, communicate with Clients, process payments, maintain records, and meet legal or operational obligations. This may include names, email addresses, phone numbers, Event dates, venue details, service selections, and notes supplied through our website or booking process.

We use reasonable safeguards and limit access to personal information to people and service providers who need it for the purposes described above. We may use third-party service providers to operate website forms, email communications, payment processing, and related business functions.

Questions, access requests, correction requests, or privacy concerns can be sent to info@onceuponafun.com.

11

Liability and Indemnity

To the maximum extent permitted by applicable law, the Company, its owners, employees, contractors, and performers are not responsible for personal injury, property damage, loss, delay, or expense arising from the Event, venue, guests, weather, unsafe conditions, or lack of supervision, except to the extent caused by the Company’s gross negligence or intentional misconduct.

To the maximum extent permitted by applicable law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of enjoyment, or emotional distress.

The Client agrees to indemnify and hold harmless the Company, its owners, employees, contractors, and performers from claims, damages, losses, costs, and expenses arising from the Client’s Event, venue, guests, invited third parties, or the Client’s breach of these Terms, except to the extent caused by the Company’s gross negligence or intentional misconduct.

Nothing in these Terms limits any right or remedy that cannot be excluded or limited under applicable law.

12

Intellectual Property and Character References

The Company retains all rights in its original branding, logos, photographs, website content, written materials, designs, and other content that it owns or is authorized to use. Clients may not copy, reproduce, distribute, modify, or use that material without our prior written permission.

Some character names, marks, and related intellectual property may belong to their respective owners. References to third-party characters are used only to describe entertainment concepts or requested appearances. Once Upon a Fun does not claim ownership of third-party intellectual property and is not affiliated with, sponsored by, or endorsed by the owners of those marks unless expressly stated in writing.

13

Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there.

Before starting a legal proceeding, the Client and the Company will make reasonable efforts to resolve the concern informally. Either party may give written notice describing the issue, and the parties will have at least 15 calendar days to attempt a good-faith resolution. If the issue is not resolved, either party may pursue available remedies in the courts of New Brunswick, subject to any mandatory rights or forum requirements under applicable law.

14

Changes, Severability, and Entire Agreement

We may update these Terms from time to time. Updated Terms apply from the effective date shown on this page. Updated Terms do not change a booking already confirmed before that date unless the Client and the Company agree to the change in writing.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of that provision or any other provision.

These Terms, together with the applicable written quote, booking confirmation, signed event agreement, invoice, approved add-ons, and written media release, form the entire agreement between the Client and the Company regarding the Event and replace prior discussions or understandings about that Event.
